This Privacy Policy is designed in accordance with Article 13 of the EU General Data Protection Regulation (2016/679) and covers personal data collected through the Binesta application.
Binesta is operated by Hadi Askari, registered as a French micro-entreprise (Hadi Askari EI), based in France. As the data controller under the EU General Data Protection Regulation (GDPR), we are responsible for the personal data described on this page.
We do not sell your data, and we do not share it with advertisers. We share data with exactly one third-party processor, described in full below — we do not use any other third-party host or subprocessor for your Instagram data.
All Instagram Platform Data we fetch on your behalf — account insights, media captions, and (once approved by Meta) DM previews — is stored exclusively on our own self-hosted server located in France. We do not use any third-party cloud storage or hosting provider for this data; it never leaves infrastructure we operate directly.
To generate the diagnoses, recommendations, and content suggestions that are the core of Binesta, we send relevant Instagram Platform Data — account insights, media captions, and (once approved by Meta) DM previews — to Anthropic PBC's Claude API in real time, for the sole purpose of producing that response. Anthropic is our only third-party sub-processor, and its use is limited strictly to this real-time analysis — Anthropic is not used for storage, and we do not retain your data on Anthropic's infrastructure beyond what is needed to generate each response.
This processing takes place on Anthropic's US-based infrastructure. Because this involves transferring personal data from the EU to the United States, it is covered by the Standard Contractual Clauses (SCCs) incorporated in Anthropic's Data Processing Addendum, which is the GDPR-recognized legal mechanism Anthropic offers for this transfer. We keep your account data, connected Instagram metrics, and content history for as long as your account is active, since the app's diagnosis and recommendations get more accurate over time by building on your own history. We delete data only when you request it (see Data Deletion below) or close your account.
If you stop using Binesta without disconnecting Instagram or requesting deletion, we consider the account dormant after 12 months of no login. Before deleting anything, we will email you advance notice at the address on file. If we don't hear back, we delete the account and all associated data 30 days after that notice.
If you disconnect your Instagram account, we keep your historical performance metrics (reach, engagement, and per-post data already fetched) for 180 days in case you reconnect. After 180 days without reconnecting, that historical performance data is automatically deleted. Your saved learnings (what the Advisor has learned works or doesn't work for your page) are kept regardless of disconnection, since they don't depend on an active Instagram connection.
We process your account data on the basis of contract (to provide the service you signed up for) and, when you connect an Instagram account, your explicit consent to the specific permissions requested at connection time. You can withdraw that consent at any time by disconnecting the account or requesting deletion below. The transfer of data to Anthropic in the United States, described above, is safeguarded by the Standard Contractual Clauses in Anthropic's Data Processing Addendum, which provide the legal basis recognized under GDPR for this specific international transfer.
Binesta uses exactly one cookie: binesta_session, which keeps you logged in. It is strictly necessary for the service to function — without it, you would need to log in again on every page. This cookie is set only after you log in, is readable only by our own server (it is not accessible to JavaScript or any third party), and is automatically removed 30 days after your last login or immediately when you log out.
We do not use analytics cookies, advertising cookies, or any third-party tracking cookies. Because our only cookie is strictly necessary for the service (not for analytics, personalization, or advertising), French and EU cookie rules (CNIL guidance implementing the ePrivacy Directive) do not require us to ask for your consent to set it — only to disclose it, which this section does. If we ever add analytics or other non-essential cookies in the future, we will update this section and add a consent mechanism before doing so.
Under GDPR, you have the right to access, correct, export, or delete your personal data, and to object to or restrict certain processing. You can request a copy of your data or ask us to delete it at any time — see Data Deletion below. If you believe your rights have not been respected, you also have the right to lodge a complaint with your national data protection authority (in France, the CNIL).
Binesta is a tool that analyzes Instagram performance data from an account you connect, and generates content suggestions. It does not post to Instagram on your behalf, does not guarantee any specific business outcome, and its suggestions should be treated as advice, not instructions.
The service is provided "as is." Diagnoses and content suggestions are generated by AI and general platform knowledge — they may be wrong, and any content you publish based on them is your own decision and responsibility.
You can stop using the service and request deletion at any time. We may suspend accounts that violate these terms or Instagram's platform policies.
We may update these terms as the product develops. Material changes will be noted on this page with an updated date.
